1.

Parties & Rental Details

This agreement is between Clear Bayou Collective (Owner) and the named renter (Renter). The specific trailer, pickup date, return date, daily rate, and security deposit are confirmed at pickup and reflected on your booking confirmation.

Renter Responsibilities

  • Renter must be 18 years or older with a valid driver's license.
  • Renter is responsible for the trailer at all times during the rental period.
  • Renter must ensure the tow vehicle is rated to tow the trailer's gross weight.
  • Renter shall not sublet, loan, or transfer the trailer to another party.
  • Renter must return the trailer clean and free of debris.
  • Renter must return the trailer with all tie-down straps and accessories provided at pickup.
3.

Damage & Liability

  • Renter accepts responsibility for all damage occurring during the rental period, beyond normal wear and tear.
  • Pre-existing damage is documented with timestamped photos at pickup and is excluded from renter liability.
  • Renter's personal auto insurance may provide coverage — renter is responsible for verifying this before pickup.
  • Owner is not liable for damage to the renter's vehicle, property, or cargo.
  • Renter is responsible for all traffic citations, tolls, and fines incurred during the rental period.
4.

Security Deposit

A refundable $100 security deposit is held on Stripe at the time of booking. The deposit is released within 24 hours of trailer return, provided the trailer is returned undamaged, on time, and clean.

Deductions may be made for: damage beyond normal wear, missing equipment, excessive cleaning, or late return fees.

5.

Late Returns

  • Trailer must be returned by the agreed return time.
  • Late returns are billed at the daily rate, prorated by the hour (minimum 1-hour charge).
  • Owner reserves the right to charge the security deposit for unreturned trailers.
6.

Prohibited Uses

  • Hauling hazardous materials, chemicals, or flammable substances.
  • Use in any illegal activity.
  • Off-road or unpaved-road use beyond normal residential driveways.
  • Loading beyond the trailer's rated capacity.
  • Towing with an undersized or improperly equipped vehicle.
7.

Breakdown & Emergencies

In the event of a breakdown or accident, renter must notify the Owner immediately at (281) 857-1206.

  • Renter shall not authorize repairs without the Owner's prior written consent.
  • Owner is not responsible for renter's costs due to breakdown, including storage, towing, or rental of alternative equipment.
8.

Signatures

By reserving a trailer through this site you accept these terms. Both parties also sign a paper copy at pickup; each keeps one. The agreement is binding upon signing.
